A ruling has finally come in the nepotism challenge to candidacy for Donald Wayne Ward in the race for Elbert County Board of Education District Three.
The challenge was on the grounds that it is prohibited by law that Ward’s being the spouse of a sibling (Polly Ward) of a current board member (Ben Baker) under O.C.G.A 20-2-51(c)(4)(A).
On that challenge, Judge Tate ruled in accordance to another rule of statutory construction presented in which the Court must “look diligently for the intention of the General Assembly, keeping in view at all times the old law, the evil, and the remedy”, which is from O.C.G.A. 1-3-1(a).
Under that statute, according Judge Tate’s ruling, it appears clear the remedy intended was to prevent close family relatives, even those not related by blood, from serving together.
Judge Tate ruled that the challenges to the candidacy of Mr. Donald Wayne Ward are granted, meaning that Ward has been disqualified in the race for the Elbert County Board of Education District Three seat on the grounds of the nepotism challenge.
Ward was originally slated to face off against Incumbent Republican Pamelia Jo Phelps in the May Primary Election.
